Patent Registration

Patent registration is a formal legal process that allows inventors to obtain exclusive ownership rights over their innovations—whether it is a product, method, technology, or design. A registered patent gives the inventor full authority to use, manufacture, sell, or license the invention for a defined period (usually 20 years). Registering a patent helps prevent others from copying, producing, or commercially exploiting the invention without the inventor’s consent.

Who Can Apply for Patent Registration?

A wide range of innovations can be patented in India, provided they are novel, involve inventive steps, and can be industrially applied. Patent protection applies to:

  • Products: New tangible inventions such as devices, machinery, tools, pharmaceuticals, and manufactured items.
  • Processes or Methods: Novel industrial or manufacturing processes, operational methods, or technical workflows.
  • Machines: Mechanical innovations or unique engineering mechanisms.
  • Manufactured Goods: Products made with unique features, processes, or enhancements.
  • Chemical Compositions: New chemical substances, drug formulations, or compound materials.
  • Biotechnological Inventions: Innovations in genetic engineering, molecular biology, cloning, biotech processes, etc.
  • Software & Digital Innovations: Patentable software systems and algorithms (subject to compliance with Indian patent criteria).
Types of Patent Registrations

Patent applications are classified into the following categories based on the nature of innovation:

  • Utility Patent: Granted for new and useful inventions relating to machines, processes, manufactured items, compositions of matter, or improvements.
  • Design Patent: Granted for new and original ornamental designs applied to manufactured articles (appearance-based protection).
  • Plant Patent: Granted for inventors who develop a new distinct variety of plant through asexual reproduction.

  • Form 5: Inventor Ship Declaration The 1970 Patents Act (39 of 1970) and the 2003 Patent Rules.
  • Power of Attorney Form 26. The 1970 Patents Act (39 of 1970) and the 2003 Patent Rules. This form is required if a patent agent filed your patent; otherwise, it is not.
  • Form 3 (Corresponding statement and commitments for a foreign patent application) The 1970 Patents Act (39 of 1970) and the 2003 Patent Rules.
  • Priority Document: In the event that a priority date is claimed, this is used for convention applications.
  • The invention's drawings and illustrations.
