Trademark Registration in India

Trademark Registration is the legal process of protecting a brand name, logo, slogan, symbol, sound mark, or other unique identity associated with a business. A registered trademark helps customers recognize your products or services and protects your brand against misuse, imitation, or unauthorized usage.

The trademark registration process in India may take approximately 6 to 24 months depending on examination status, objections, and oppositions. Once the application is submitted, the applicant can immediately start using the ™ symbol. Upon successful approval, a registration certificate is issued, allowing use of the ® symbol.

A registered trademark is valid for 10 years from the date of approval and can be renewed indefinitely every 10 years, ensuring long-term brand protection.

Types of Trademark Symbols

  • ™ (TM Symbol)

Indicates that a trademark application has been filed and is awaiting approval.

  • ® (Registered Symbol)

Used only after the trademark is officially registered with the Trademark Registry.

  • ℠ (Service Mark)

Used for trademark applications related to services rather than goods.

Benefits of Trademark Registration

Registering a trademark provides legal rights, business advantages, and brand protection:

  • Legal Ownership: Exclusive rights to use the trademark nationwide.
  • Brand Trust & Recognition: Builds credibility and consumer loyalty.
  • Business Asset: A trademark becomes an intangible asset that can be sold, licensed, or franchised.
  • Protection Against Infringement: Enables legal action against unauthorized use or copying.
  • Cost-Effective Protection: Once registered, renewal is required only every 10 years.
